Heartbreakers enter into subconscious of Chili Peppers

Last week, radio presenter Dan Gaffney of Delaware-based WGMD accused the band (Red Hot Chili Peppers) of ripping off Tom Petty and the Heartbreakers. He claims that the leading single from the new album, "Dani California," sounds almost identical to Petty's "Mary Jane's Last Dance".

Gaffney's show producer has this this mp3 at his blog in which he compares the intro and first verse of each, one after the other, then together. It's a pretty powerful piece of "evidence".

Instead of theft, this is probably more like the whole "My Sweet Lord"/"He's So Fine" situation involving George Harrison, where the plagiarism was unintentional. Harrison also "borrowed" the phrase "Something in the way she moves" for his song "Something" from a James Taylor song, strangely enough titled "Something In The Way She Moves".
